OpenAI and Anthropic are exploring ways to use investor money to manage potential copyright settlements, the Financial Times reported. The companies face lawsuits alleging their AI systems trained on copyrighted works without authorization, alongside Microsoft and Meta.
OpenAI has secured AI risk insurance worth up to $300 million through Aon, though insiders say that amount is far below potential legal exposure. To fill the gap, OpenAI is considering a “captive” insurance vehicle funded by investors — a form of self-insurance common among large corporations handling emerging risks.
Anthropic, which recently saw a U.S. judge approve a $1.5 billion preliminary settlement over similar claims, is reportedly using its own reserves to fund possible payouts.
The report underscores how AI developers are struggling to find adequate insurance coverage as copyright and data disputes multiply. Neither company has commented publicly on the matter.
